By accessing or using ExamPrep's website, mobile applications, and services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and ExamPrep Inc. ("ExamPrep", "we", "us", or "our"). You represent that you are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use the Service and that they have read and agreed to these Terms on your behalf.

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

Account Creation

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately if you discover or suspect any security breaches related to the Service
• Take responsibility for all activities that occur under your account

Account Suspension and Termination

We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms or applicable laws. You may terminate your account at any time by contacting us or through your account settings.

ExamPrep provides test preparation services for various standardized exams including but not limited to SAT, ACT, GMAT, GRE, MCAT, and LSAT. Our services include:

• Practice tests and questions
• Study materials and guides
• Personalized study plans
• Progress tracking and analytics
• Tutoring services (where available)
• Community forums and discussion boards

Service Limitations

While we strive to provide accurate and up-to-date materials, we cannot guarantee that our services will ensure any specific exam result or score improvement. ExamPrep is not affiliated with or endorsed by any official testing organizations.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Technical Requirements

You are responsible for obtaining and maintaining all equipment and services needed for access to and use of the Service. You are also responsible for ensuring such equipment and services are compatible with the Service.

Fees and Billing

Certain aspects of the Service are provided for a fee. By selecting a paid service, you agree to pay all applicable fees. Fees are non-refundable except as required by law or as otherwise stated in these Terms.

We use third-party payment processors to handle all financial transactions. You agree to provide current, complete, and accurate purchase and account information for all purchases made through the Service.

Subscription Terms

Some services are offered on a subscription basis with automatic renewal. By purchasing a subscription, you agree to:

• Pay the subscription fee at the then-current rate
• Have your subscription automatically renew at the end of each billing cycle
• Maintain valid payment information on file

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing cycle.

Refund Policy

We offer a 14-day money-back guarantee for all new subscriptions. To request a refund, please contact our support team within 14 days of your initial purchase.

Refunds are not available for:

• Partial months of service
• Services that have been substantially used or accessed
• Renewal payments
• Purchases made through third-party platforms (subject to their refund policies)

All refund requests are subject to review and approval at our sole discretion.

Our Content

The Service and its original content, features, and functionality are owned by ExamPrep and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

All ExamPrep content, including but not limited to practice questions, study materials, tests, and software, is provided for your personal, non-commercial use only. You may not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content for any other purposes without our prior written consent.

Third-Party Content

The Service may contain content from third parties. Such content is the property of its respective owners and is subject to their terms and conditions.

Trademarks

The ExamPrep name and logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ExamPrep or its affiliates or licensors. You may not use such marks without our prior written permission.

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial purposes.

Content Ownership

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service.

Content Standards

You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the User Content and grant us the license above.

You agree not to post User Content that:

• Infringes any third party's copyright, trademark, patent, or other intellectual property rights
• Violates any law or regulation
• Is defamatory, obscene, pornographic, or offensive
• Promotes violence, discrimination, or illegal activities
• Contains private information of third parties without their consent
• Contains viruses or other malicious code

Content Monitoring

We reserve the right to monitor, review, and remove any User Content at our sole discretion. However, we have no obligation to monitor or review User Content.

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Prohibited activities include but are not limited to:

• Attempting to interfere with or compromise the integrity or security of the Service
• Using the Service to harass, abuse, or harm another person
• Impersonating another user or person
• Sharing your account credentials with others
• Attempting to circumvent any content-filtering techniques
• Deciphering, decompiling, disassembling, or reverse engineering any software
• Using any automated system to access the Service in a manner that sends more request messages than a human could reasonably produce
• Uploading or transmitting viruses or other malicious code
• Collecting or tracking personal information of others
• Using the Service for any commercial purpose without our express written consent
• Sharing ExamPrep content with non-users

We reserve the right to terminate your account for violating these prohibited uses.

These Terms remain in effect while you use the Service. We may suspend or terminate your account or cease providing you with all or part of the Service at any time for any reason, including if we reasonably believe you have violated these Terms.

Upon termination, all rights granted to you under these Terms will immediately cease. Provisions of these Terms that by their nature should survive termination will survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us at info@getexamprep.com. Upon termination, we will delete your account information in accordance with our Privacy Policy, though we may retain certain information as required by law or for legitimate business purposes.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. ExamPrep expressly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that:

• The Service will meet your requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results that may be obtained from the use of the Service will be accurate or reliable
• The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations
• Any errors in the Service will be corrected

No advice or information, whether oral or written, obtained by you from ExamPrep or through the Service shall create any warranty not expressly stated in these Terms.

ExamPrep does not guarantee any specific results from use of the Service, including specific exam scores or admissions outcomes.

To the fullest extent permitted by applicable law, in no event shall ExamPrep, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall ExamPrep's aggregate liability exceed the greater of one hundred U.S. dollars (U.S. $100.00) or the amount you paid ExamPrep, if any, in the past six months for the Service giving rise to the claim.

The limitations of this section apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence), or otherwise, and whether or not ExamPrep has been informed of the possibility of any such damage.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. Payment of all filing, administration, and arbitrator fees will be governed by the AAA's rules.

You and ExamPrep agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Jurisdiction

For any matters not subject to arbitration, you and ExamPrep agree to submit to the personal and exclusive jurisdiction of the courts located within San Francisco County, California.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice through the Service, by sending you an email, or by other means.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

We will indicate at the top of this page the date these Terms were last revised. You are responsible for reviewing these Terms periodically for any changes.
